More on the Aubry Peters Killing in Indiana

Jacob Travis McDaniel, 20, reportedly took the clip out of the gun he used to slay the 16-year-old girl before pointing it at her chest and pulling the trigger. However, the little numbskull didn't check the chamber. It's a pretty universally known fact that there is usually "one in the chamber" when it comes to handguns, so either this guy is a complete nincompoop, or this accident wasn't as accidental as everyone is accepting it to be.
The situation reportedly took place when McDaniel was showing off his guns, undoubtedly a happy new gun owner who had not been given the proper gun owner education that he should have been required to have before even operating a gun, much less owning one. It's reported that he wanted Aubrey to hold the handgun that ended up killing her, but she refused -- wisely declining because she felt uncomfortable. Jacob McDaniel then reportedly took out the clip, aimed and fired.
"What just happened?"

According to the ABC report, the young idiot gun owner is being charged with reckless homicide.  I'm not sure what the author of the above article wants, first degree murder, maybe?

  1. The main difference between first degree murder and any other is premeditation. So you would need some evidence of that.

    Sounds like an act he thought about before pulling the trigger. He did it intentionally.

    1. A charge of murder always includes intent to harm. Premeditation means he planned to commit that murder ahead of time.

    4. My apologies Anon, kids are here and got distracted. Different states have different standards. But what it boils down to is being able to prove to a jury that some forethought went into planning the crime.
      For example, Oswald killing President Kennedy is easily a well thought out event. Killing someone in a bar fight would likely not.

    5. Anonymous, there was a day when people would think twice about calling someone a coward who has served in our military and risen to the rank of staff sergeant. But Anonymous, you feel free to use the liberties that he defends. You see, you have the right to be a snivelling coward who demeans those who protect you. What you do not have is any justification for feeling yourself worthy of speaking such filth.

    6. Shove the "he served in the military so I MUST respect him" garbage. When lies and bullshit is served, I'll call it. He claims the children distracted him, yet, he made comments and responded to other comments mant times on oter posts before he came back and said he couldn't respond because of his children. I call that bullshit. I have no respect for people like you who lie, especially when talking about life and death issues. Respect is something earned. You don't automatically get it because you wore a uniform. Being the site cowardly criminal liar, I wouldn't expect you to understand that concept.

      I'm impressed that you can take an apology and so artfully refuse it. As I said, my kids were here for the weekend and I didn't notice you were referring to me. Considering that most of your posts are directed to Greg, it isn't hard to do. When I saw Greg's comment to you I realized that you were talking to me.
      You are correct that respect is earned. For instance, while I don't agree with Mike in many areas, I do respect him for being willing to allow comments on his blog and not getting the vapors when people disagree with him. A rare occurrence in discussions on this issue, so in return for his hospitality, I do try to keep things civil and to the point for the most part.

    13. Mike, a Sergeant First Class in the Army is the same pay grade as a Gunnery Sergeant. Though the Gunny would likely not admit any other level of equality. *grin*
      I did talk to a Lance Corporal once in Iraq and he asked me if he was supposed to call me Gunny, and I told him it likely wasn't a good idea, because a real one might hear him.

    16. Just keep in mind what Anon said so eloquently earlier. Respect is earned, which I do try to live by. There are those that play the system. As an example, after I was promoted, I got a platoon to run after their platoon sergeant was relieved. That SFC, last I heard, is now a Sergeant Major.

  3. This is at least reckless homicide. The police should look long and hard at whether it was more than that.
